reSWAPP Seller Terms and Conditions

These Terms and Conditions create a contract between you and CONTEMPORARY BOX, LDA (“reSWAPP”) if you supply used clothing, shoes and/or accessories ("Goods") to reSWAPP.
How It Works
reSWAPP facilitates a streamlined wardrobe clean-out experience for you. As a Client, you send your items in Clean-Out Bags to reSWAPP. Upon receiving your Goods, reSWAPP conducts inspections to determine which items will be listed for sale through our Services (collectively referred to as the "Property").
Once your Clean-Out Bag has undergone processing, reSWAPP will notify you about the items accepted for sale. For further details on the overall Clean-Out procedure, please consult our FAQ section.
Acceptance Conditions
reSWAPP only accepts Goods that meet reSWAPP acceptance standards. We may reject an item for any reason. Each item will be evaluated to determine, in our sole discretion, whether the item: (a) is in excellent, new or like-new condition, and if needed, that has been freshly laundered and completely dried; (b) is free from stains, pilling, holes, odor, and any other signs of excess wear; (c) is in-season and on-trend; and (d) is authentic. Fees for Additional Services
reSWAPP may charge fees for certain services associated with the wardrobe clean-out process. These services may include logistics services, insurance services, and other specified services that will be detailed during the ordering process. The exact fees for these services will be determined at that time. Your transaction will be confirmed by the issuance of an invoice or payment confirmation provided by reSWAPP.
RETURN ASSURANCE
We are committed to providing fair compensation for your items. If you are not satisfied with our payout offer, we will return your items (all or selected by you) at no cost after we receive a Return Request from you following our offer.
YOUR REPRESENTATIONS, WARRANTIES, AND INDEMNIFICATION
You hereby represent and warrant that (a) you have good and marketable title to each item of Property and have the right to sell the Property; (b) none of the Property is subject to any liens or other encumbrances; (c) the Property does not include stolen or counterfeit goods or goods that are illegal to sell; and (d) the Property does not infringe upon, misappropriate, or violate any trademark, copyright, or other intellectual property or other proprietary right of any third party, any state or federal law, or any administrative regulation.
Payouts
Estimated listing prices are determined by many factors, including the estimated retail price, brand, seasonality, and quality of each item. The estimated listing price is used to determine the payout amount provided in the report for the Goods upon the sorting and estimate being completed by reSWAPP.
Payout offers are based on the item Estimated listing price. You will be provided with a Payout report upon reSWAPP receives and processes your Clean-Out Bag.
You will not receive any Payout offer for certain item categories that are ineligible for payout, for example:
Upon receiving the Payout report, you are expected to either confirm for Cash Out or submit a Return Request (additional information provided in the Return Assurance section). .If a Cash Out request is not submitted within 72 hours from the payout offer provided by reSWAPP, the offer will be considered accepted, and you will receive the payout as per the earlier provided report.
reSWAPP assumes financial responsibility for up to 30 EUR per bag if a Clean-Out Bag cannot be processed due to errors or mishandling on our part. In the event that a Clean-Out Bag is lost during transit by the shipping company, reSWAPP will file a complaint with the shipping company and conduct an investigation according to the logistics provider's terms. Compensation will be determined based on the findings of the investigation and will be issued once the investigation is concluded.
Items listed on third-party
reSWAPP reserves the right to list and sell any items on third-party platforms (including online auctions, omnichannel retail partners and other relevant distribution channels). reSWAPP can execute the right for selling only upon receiving the payout offer acceptance.
Counterfeit and Stolen Items
You acknowledge and understand that reSWAPP is subject to laws and regulations relating to claims that resold items are counterfeit, have been stolen, or otherwise violate applicable law. reSWAPP fully cooperates with law enforcement and brands seeking to track down the source of counterfeit items.
You are responsible for ensuring the authenticity of all Property you provide to us. reSWAPP’s authentication process is proprietary and independent. If reSWAPP cannot verify the authenticity of an item in your Clean-Out Bag or it does not otherwise meet our authenticity standards, we reserve the right in our sole discretion to refuse to accept the item. reSWAPP reserves the right to destroy apparel it deems to be counterfeit in accordance with applicable laws. You acknowledge and agree that any item determined by reSWAPP to be counterfeit will not be returned to you and will be destroyed unless Return Request is submitted.
Title to Property
Title to each item of Property supplied in the Clean-Out bag will transfer to reSWAPP once payout offer confirmation is provided. You will continue to own and have title to each item of Property in case of Return Request submitted or till Payout Offer Confirmation is provided.
Payout and Other Disputes
If there is a dispute between you and reSWAPP, reSWAPP will have no obligation to pay any payout or other amounts due to you, including without limitation, amounts unrelated to the dispute, unless and until the dispute is resolved. reSWAPP may withhold any payout earnings due to you (including any due for sold items of Property not subject to the dispute) in full or partial satisfaction of any amounts you owe to reSWAPP.

- Damaged items (tears, holes, missing parts, broken zippers, altered hems, missing labels)
- Restricted categories (jewellery, underwear, intimates)
- Counterfeit items
- Items lacking a size label (unless they are one size)
